<p>Please note that posting requirements vary by statute; that is, not all employers are covered by each of the Department&#8217;s statutes and thus may not be required to post a specific notice. For example, some small businesses may not be covered by the Family and Medical Leave Act and thus would not be subject to the Act&#8217;s posting requirements. 			<content:encoded><![CDATA[<p><a href="http://truthinpayroll.com/wp-content/uploads/2012/01/AuditChecklist.gif"><img class="alignright size-full wp-image-1355" title="AuditChecklist" src="http://truthinpayroll.com/wp-content/uploads/2012/01/AuditChecklist.gif" alt="W2 Reporting of Employer Paid Insurance" width="250" height="188" /></a>Reporting the employer paid insurance on employee W-2s is voluntary for all employers for 2011 and small employers for 2012.  However, employers with more than 250 W-2s for tax year 2012 will be required to report the employer paid insurance amounts on all employees&#8217; W-2s, due to the Affordable Care Act.</p>
<p>In general, the amount reported should include <strong>both</strong> the portion paid by the employer and the portion paid by the employee whether or not it was pre-tax.  In the case of a health FSA, the amount reported should not include the amount of any salary reduction contributions.</p>
<p>The cost of these health care benefits will be reported in <strong>Box 12</strong> of the Form W-2, with <strong>Code DD</strong>.  It is listed for informational purposes only, and is <strong>not taxable</strong>.</p>
<p>For W-2s filed for the 2011 calendar year, employers are not required to report the value of health benefits provided, although they may do so voluntarily. For years after 2011, employers generally are required to report the value of health benefits provided on the Form W-2. Transition relief is available for certain employers and with respect to certain types of coverage.  Reporting for these employers is not required until future guidance is provided. The transition relief applies to the following:</p>
<ol>
<li>Employers filing fewer than 250 Forms W-2 for the previous calendar year (for example, employers filing fewer than 250 2011 W-2s) will not be required to report the cost of coverage on the 2012 Forms W-2</li>
<li>Multi-employer plans</li>
<li>Health Reimbursement Arrangements</li>
<li>Dental and vision plans that are not integrated into another group health plan</li>
<li>Self-insured plans of employers not subject to COBRA continuation coverage or similar requirements</li>
<li>Employers furnishing Forms W-2 to employees who terminate before the end of a calendar year and request a Form W-2 before the end of that year</li>
</ol>

<p>There are many benefits that come from being your own boss. If you work for yourself, as an independent contractor, or you carry on a trade or business as a sole proprietor, you are generally considered to be self-employed.</p>
<p>Here are six key points the IRS would like you to know about self-employment and self- employment taxes:</p>
<ol>
<li>Self-employment can include work in addition to your regular full-time business activities, such as part-time work you do at home or in addition to your regular job.</li>
<li>If you are self-employed you generally have to pay self-employment tax as well as income tax. Self-employment tax is a Social Security and Medicare tax primarily for individuals who work for themselves. It is similar to the Social Security and Medicare taxes withheld from the pay of most wage earners. You figure self-employment tax using a Form 1040 Schedule SE. Also, you can deduct half of your self-employment tax in figuring your adjusted gross income.</li>
<li>You file an IRS Schedule C, Profit or Loss from Business, or C-EZ, Net Profit from Business, with your Form 1040.</li>
<li>If you are self-employed you may have to make estimated tax payments. This applies even if you also have a full-time or part-time job and your employer withholds taxes from your wages. Estimated tax is the method used to pay tax on income that is not subject to withholding. If you fail to make quarterly payments you may be penalized for underpayment at the end of the tax year.</li>
<li>You can deduct the costs of running your business. These costs are known as business expenses. These are costs you do not have to capitalize or include in the cost of goods sold but can deduct in the current year.</li>
<li>To be deductible, a business expense must be both ordinary and necessary. An ordinary expense is one that is common and accepted in your field of business. A necessary expense is one that is helpful and appropriate for your business. An expense does not have to be indispensable to be considered necessary.</li>
</ol>

The widgets feature the latest tax initiatives and programs and can be found on Marketing Express, the marketing site that allows IRS partners and tax preparers to customize their IRS communications products.</li>
<li><strong>RSS</strong> Really Simple Syndication, or RSS, is an easy way to gather a wide variety of content in one place on your computer. The IRS now offers RSS feeds. RSS, is an easy way to get the news you want whenever it is updated, even if you are not on our website.</li>

<p>Keep in mind that the IRS uses these tools to share information with you. Do not post any confidential information on new or social media sites, especially your Social Security number. The IRS will not be able to answer personal tax or account questions through any of these services.</p>

			<content:encoded><![CDATA[<p><a href="http://truthinpayroll.com/wp-content/uploads/2012/01/banks.gif"><img class="alignright size-full wp-image-1361" src="http://truthinpayroll.com/wp-content/uploads/2012/01/banks.gif" alt="Employee Net Pay" width="225" height="188" /></a>Each year, payroll departments are inundated with inquiries about changes to the net pay employees receive.  In most cases, a simple reminder that the tax tables change as of January 1st is enough, but some employees will want to confirm that the correct amount of tax was withheld from their paycheck.  Here&#8217;s a simple way employees can do their own verification by using the tables in the &#8220;Wage Bracket Method for Income Tax Withholding&#8221; section in the IRS Publication 15, the Employer&#8217;s Tax Guide.</p>

<p><strong>Six Important Facts about Dependents and Exemptions</strong></p>
<p>IRS TAX TIP 2012-07, January 11, 2012<br />
Even though each individual tax return is different, some tax rules affect every person who may have to file a federal income tax return. These rules include dependents and exemptions. The IRS has six important facts about dependents and exemptions that will help you file your 2011 tax return.</p>
<ol>
<li><strong>Exemptions reduce your taxable income.</strong> There are two types of exemptions: personal exemptions and exemptions for dependents. For each exemption you can deduct $3,700 on your 2011 tax return.</li>
<li><strong>Your spouse is never considered your dependent.</strong> On a joint return, you may claim one exemption for yourself and one for your spouse. If you’re filing a separate return, you may claim the exemption for your spouse only if they had no gross income, are not filing a joint return, and were not the dependent of another taxpayer.</li>
<li><strong>Exemptions for dependents.</strong> You generally can take an exemption for each of your dependents. A dependent is your qualifying child or qualifying relative. You must list the Social Security number of any dependent for whom you claim an exemption.</li>
<li><strong>If someone else claims you as a dependent, you may still be required to file your own tax return.</strong> Whether you must file a return depends on several factors including the amount of your unearned, earned or gross income, your marital status and any special taxes you owe.</li>
<li><strong>If you are a dependent, you may not claim an exemption.</strong> If someone else – such as your parent – claims you as a dependent, you may not claim your personal exemption on your own tax return.</li>
<li><strong>Some people cannot be claimed as your dependent.</strong> Generally, you may not claim a married person as a dependent if they file a joint return with their spouse. Also, to claim someone as a dependent, that person must be a U.S. citizen, U.S. resident alien, U.S. national or resident of Canada or Mexico for some part of the year. There is an exception to this rule for certain adopted children. See IRS Publication 501, Exemptions, Standard Deduction, and Filing Information for additional tests to determine who can be claimed as a dependent.</li>
</ol>

<p><strong>2)     </strong><strong>What do I do if my address is wrong?</strong>  Answer: It is OK if your address on your W-2 is not accurate.  You just need to use your correct address on your tax returns and it is OK if it is different from your W-2.</p>
<p><strong>3)     </strong><strong>Why doesn’t the YTD on my last paycheck of the year match my W-2 amounts? </strong>Answer: <strong>Box 1</strong> of your W2 is for federal <span style="text-decoration: underline;">taxable</span> wages. To determine the amount in <strong>box 1, </strong>your total compensation is reduced by any pre-tax deductions or deferred earnings you’ve had within the year.</p>
<p><strong>4)     </strong><strong>Why are boxes 3 and 5 different than box 1? </strong> Answer:  <strong>Box 3</strong> and <strong>5</strong> are for <span style="text-decoration: underline;">SS &amp; Med taxable</span> wages. Some earnings and/or deductions, such as, 401K, 403B, or SIMPLE are SS &amp; Med taxable but <span style="text-decoration: underline;">not</span> taxable for Federal Income Tax (Box 1).  If boxes 3 and 5 don’t match each other, the employee probably reached the Social Security wage cap.  Social Security is only taxed on the first $106,800 wages (2011 cap) but Medicare does not have a cap.</p>
<p><strong>5)     </strong><strong>How can I prevent owing taxes when I file my annual return? </strong>Answer:<strong> </strong>Verify that your employer has an accurate W-4 Form on file, listing the proper number of withholding allowances, for your current situation.  For guidance on choosing your proper withholding allowance, visit <a href="http://www.irs.gov/">www.irs.gov</a> to access the “IRS Withholding Calculator” tool along with many other resources available, including the 2012 W-4 Form and instructions.</p>
<p><strong>6)     </strong><strong>Where are my pre-tax deductions shown on the W-2? </strong>Answer:<strong> </strong>Pre-tax deductions are not necessarily shown on your W-2.  There are only a few specific pre-tax deductions that are required to be specified or shown on your W-2.</p>
<p><strong>7)     </strong><strong>Why is the amount I had deducted for my HSA different than the amount in box 12W? </strong>Answer:<strong> </strong>The IRS requires the combined <span style="text-decoration: underline;">employee and employer</span> HSA amounts to be included in <strong>box 12W</strong>.  Your last paystub of the year can be used to determine the employee contribution amount and the employer contribution amount.</p>

The 20 states are: Arkansas, California, Connecticut, Florida, Georgia, Illinois, Indiana, Kentucky, Michigan, Minnesota, Missouri, Nevada, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Rhode Island, Virginia, and Wisconsin. <p>Employers in “credit reduction” states must remember to calculate a credit reduction as an adjustment to their FUTA tax on their <a href="http://www.irs.gov/pub/irs-pdf/f940.pdf" target="_blank">2011 Form 940</a> (PDF), Employer&#8217;s Annual Federal Unemployment (FUTA) Tax Return. “Credit reduction” states are states that did not repay the money they borrowed from the federal government to pay unemployment benefits.</p>
<p>The Department of Labor determines the credit reduction states for each year. For 2011, employers in these states must reduce their .054 credit on their Form 940 by the following amounts:</p>

<p>Employers in these states must use the <a href="http://www.irs.gov/pub/irs-pdf/f940sa.pdf" target="_blank">Schedule A (Form 940)</a> (PDF) to compute the credit reduction and attach the Schedule A to their Form 940. More information on the credit reduction, including an example on how to calculate the credit reduction is on the Schedule A (Form 940) and also in the <a href="http://www.irs.gov/pub/irs-pdf/i940.pdf" target="_blank">Instructions for Form 940</a> (PDF).</p>
<p>As a result, if employers pay wages that are subject to the unemployment tax laws of a credit reduction state, the employers must pay additional FUTA tax. Employers must include liabilities owed for credit reduction in calculating their fourth quarter deposit.</p>

			<content:encoded><![CDATA[<p><a href="http://truthinpayroll.com/wp-content/uploads/2011/12/w2form.gif"><img class="alignright size-full wp-image-1299" title="w2form" src="http://truthinpayroll.com/wp-content/uploads/2011/12/w2form.gif" alt="Employee Names on W-2s" width="250" height="166" /></a>It’s important to understand how employee names will be displayed on the W-2 forms so you can make sure they are entered correctly in the payroll system.  W-2’s provide information to your employees, the SSA, IRS and state and local governments so it’s important to try to correct any entry errors, which cause processing delays, before the end of December each year.</p>
<p>One way you can take preventative measures at year-end is by running the Employee Profile report.   This report gives detailed employee information and page breaks by employee so it can be distributed to your employees so they can make sure their W-2 information including social security number, spelling of full name and home address are correct.</p>
<p>An employee’s name should be entered exactly as it is displayed on their social security card.  If an employee has a name change, you should use the name on the original card until you see a corrected card.  Do not show titles or academic degrees, such as “Dr.,” “RN,” or “Rev.,” as those are not included on the social security card.  Generally, do not enter “Jr.,” “Sr.,” or any numerical suffixes unless the suffix appears on the card, and in that case, it should be entered after the last name in the “last name” field.  If the employee has a middle name or middle initial on their SSN card, it should be entered in the middle name field but no punctuation should be included since it needs to be entered exactly as it is on their social security card.</p>

<p>WASHINGTON — The Internal Revenue Service today issued the 2012 optional standard mileage rates used to calculate the deductible costs of operating an automobile for business, charitable, medical or moving purposes.</p>
<p>Beginning on Jan. 1, 2012, the standard mileage rates for the use of a car (also vans, pickups or panel trucks) will be:</p>
<ul>
<li>55.5 cents per mile for business miles driven</li>
<li>23 cents per mile driven for medical or moving purposes</li>
<li>14 cents per mile driven in service of charitable organizations</li>
</ul>
<p>The rate for business miles driven is unchanged from the mid-year adjustment that became effective on July 1, 2011. The medical and moving rate has been reduced by 0.5 cents per mile.</p>
<p>The standard mileage rate for business is based on an annual study of the fixed and variable costs of operating an automobile. The rate for medical and moving purposes is based on the variable costs as determined by the same study. Independent contractor Runzheimer International conducted the study.</p>
<p>Taxpayers always have the option of calculating the actual costs of using their vehicle rather than using the standard mileage rates.</p>
<p>A taxpayer may not use the business standard mileage rate for a vehicle after using any depreciation method under the Modified Accelerated Cost Recovery System (MACRS) or after claiming a Section 179 deduction for that vehicle. In addition, the business standard mileage rate cannot be used for more than four vehicles used simultaneously.</p>
<p>These and other requirements for a taxpayer to use a standard mileage rate to calculate the amount of a deductible business, moving, medical or charitable expense are in <a href="http://www.irs.gov/pub/irs-drop/rp-10-51.pdf" target="_blank">Rev. Proc. 2010-51</a>.</p>
<p><a href="http://www.irs.gov/pub/irs-drop/n-12-01.pdf" target="_blank">Notice 2012-01</a> contains the standard mileage rates, the amount a taxpayer must use in calculating reductions to basis for depreciation taken under the business standard mileage rate, and the maximum standard automobile cost that a taxpayer may use in computing the allowance under a fixed and variable rate plan.</p>
